2.1 The Website provides information about the following services:
2.2 All content presented on the Website is for informational purposes only and does not constitute legally binding offers. No contract for software development services or the purchase of software extensions is concluded solely by using the Website.
2.3 All quoted prices, examples, or service descriptions are non-binding and may be changed at any time.
3.1 Interested parties can make inquiries via the contact details provided in the legal notice (Impressum) or on the Website (e.g., by email to contact@bene.biz).
3.2 A legally valid contract for services (e.g., software development or consulting) is formed only upon individual offer by BENE.BIZ and its written acceptance (e.g., by email).
3.3 Additionally, any agreed-upon service or project contracts shall take precedence over these Terms of Serivce.
4.1 Liability for Content: As a service provider under § 7(1) TMG (German Telemedia Act), BENE.BIZ is responsible for its own content on this Website. However, no guarantee is given as to the accuracy, completeness, or timeliness of the information provided.
4.2 Liability for Links: This Website may contain links to external third-party websites over which BENE.BIZ has no influence. The respective provider or operator is always responsible for the content of the linked sites.
4.3 Website Availability: There is no entitlement to continuous availability. BENE.BIZ reserves the right to change, supplement, or discontinue parts of the Website or the entire offering without prior notice.
4.4 Exclusion of Liability: BENE.BIZ shall not be liable for slight negligence in breaching non-essential contractual obligations. In the event of a breach of essential contractual obligations, liability is limited to foreseeable and typical damages. Liability for gross negligence and intent remains unaffected.
5.1 The content used on the Website (texts, images, graphics, videos, etc.) is protected by copyright. Unless explicitly stated otherwise, all rights belong to BENE.BIZ or the respective rights holders.
5.2 Any reproduction, editing, distribution, or other use of the content requires prior written permission.
5.3 Brands & Logos: All brands used, in particular Microsoft® and Power BI®, are the property of their respective owners and are used only in accordance with the applicable regulations.
6.1 The Website references ready-made software extensions (Custom Visuals for Microsoft products).
6.2 Licensing & Purchase: The purchase and licensing of these Custom Visuals take place exclusively through the Microsoft AppSource Store. The respective terms of use and licensing conditions of the Microsoft AppSource Store as well as any additional licensing requirements of the respective Visuals apply.
6.3 No Direct Marketing: BENE.BIZ does not sell these products directly on the Website, but instead refers to the Microsoft AppSource Store for all purchase transactions, payments, and license assignments.
6.4 No Control over Store Processes: BENE.BIZ assumes no responsibility for payment processing, technical procedures, or any disruptions in the Microsoft AppSource Store.
7.1 The Website presents Docus, a document workspace application that is installed into the customer’s own Microsoft® 365 tenant and runs on SharePoint® Online.
7.2 Licensing & Purchase: Docus is subscribed to and licensed exclusively through the Microsoft® Commercial Marketplace. The terms of use and billing rules of the Microsoft® Commercial Marketplace apply in addition to these Terms of Service.
7.3 Governing Product Terms: The use of Docus itself is governed by the separate Docus End User License Agreement (EULA). In the event of a conflict between these Terms of Service and the Docus EULA regarding the Software, the Docus EULA prevails.
7.4 Per-User Licensing: Docus is licensed per user with volume-based pricing tiers. Licences are assigned by the customer’s own administrator through the Microsoft® 365 Admin Center. Prices displayed on the Website are non-binding indications; the binding price is the one shown in the Marketplace listing at the time of purchase.
7.5 Technical Prerequisites: Docus requires an active Microsoft® 365 subscription including SharePoint® Online, administrative consent for the permissions the application requires, and connectivity to the licence validation service described in the Docus EULA and the Docus Privacy Policy. Individual optional features require further Microsoft® licences that are not included — in particular, Copilot functionality requires each user to hold their own Microsoft® 365 Copilot licence.
7.6 No Direct Marketing: BENE.BIZ does not sell Docus directly on the Website but refers to the Microsoft® Commercial Marketplace for all purchase transactions, payments, and licence assignments. BENE.BIZ does not collect or process payment card or bank details.
7.7 No Control over Marketplace Processes: BENE.BIZ assumes no responsibility for payment processing, licence provisioning, technical procedures, or disruptions within the Microsoft® Commercial Marketplace, nor for changes, outages, or deprecations in the underlying Microsoft® services on which Docus depends.
8.1 Clients requiring a license for Custom Visuals for more than 1000 users per month may send a direct inquiry to contact@bene.biz.
8.2 Clients requiring Docus for more than 10,000 users may likewise request an individual enterprise offer at contact@bene.biz. Such an offer may include a dedicated billing arrangement, priority support, onboarding and migration support, custom integrations, compliance documentation and security-review support, and a service level agreement.
8.3 If an individual offer is made, a contract is only concluded upon written acceptance. The actual license administration continues to take place through the Microsoft® Commercial Marketplace or the Microsoft® AppSource Store, as far as the technical implementation allows.
9.1 The collection and processing of personal data (e.g., as part of contact inquiries) is carried out in accordance with applicable data protection laws (particularly the GDPR).
9.2 Detailed information on this is provided in the Privacy Policy.
9.3 Product-specific processing is described separately: for Docus in the Docus Privacy Policy, and for the Power BI visuals in the Custom Visuals Privacy Policy. For Docus, a data processing agreement is available on request.
10.1 BENE.BIZ reserves the right to amend these Terms of Serivce at any time to reflect legal or technical changes.
10.2 The current version is always provided on the Website. Users should regularly check for the latest version.
11.1 All disputes arising from or relating to these Terms of Serivce shall be governed by German law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
11.2 If legally permissible, the exclusive place of jurisdiction is the Local Court of Frankfurt am Main (Amtsgericht Frankfurt am Main), Germany.
If any provision of these Terms of Serivce is or becomes invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid provision that most closely reflects the economic intent and purpose of the invalid one shall apply.
